Marry Mubaiwa’s bail hearing deferred

THE High Court of Zimbabwe Thursday postponed the hearing on the bail application of Marry Mubaiwa, the estranged wife of Vice President Constantino Chiwenga, to December 31,2019.

High Court judge, Justice Webster Chinamora  said the bail application will only be considered after the State filed its response.

Mubaiwa is being charged for fraud, attempted murder, externalisation of foreign currency and money laundering.

Through her lawyers, Mtetwa & Nyambirai Legal Practitioners, Mubaiwa, had failed to get a bail in respect of the charges in the Harare Magistrate Court last week and was remanded to December 30,2019 for trial.

But, she appealed to the High Court. The bail application hearing in respect of the murder case and appeal against other charges was set for Thursday.

But, has now been postponed to December 31,2019.

In the application, Mubaiwa, denied the charges being levelled against her.

Her lawyers said she is not capable to stand trial due to her current physical condition. They argued that she should be in hospital undergoing treatment.

The lawyers argued that she was not a danger to society and that she had no capacity to interfere with State witnesses, who are members of the security forces.

The State is, however, opposed to the applicant being granted bail saying she is likely to abscond and not stand trial.  The State also said the release of Mubaiwa on bail was likely to undermine or jeopadise the objectives of proper functioning of the criminal justice system.
